About the Mediator
Angela Kershaw is a senior family lawyer with over 20 years’ experience practising in relationship property, trust, and estate matters, including complex disputes involving family trusts, companies, estates, and inter‑generational wealth.
She has been a qualified member of the New Zealand Law Society Panel of Family Mediators since 2013 and regularly assists parties to resolve disputes that sit at the intersection of family law, trust law, and estate administration.
In addition to her mediation practice, Angela:
- acts extensively in relationship property disputes, including matters involving trusts and companies;
- acts extensively in estate administration and estate dispute matters, including contested estates and beneficiary claims;
- advises and represents parties in trust disputes, including trustee decision‑making and breach of trust issues;
- act as lawyer for subject person in PPPR proceedings relating to capacity and decision making; and; and
- holds the role of Deputy Lawyer Member of the Mental Health Review Tribunal.
Her approach to mediation is legally informed, structured, and pragmatic, with a strong focus on resolution. Angela brings a clear understanding of how matters are likely to unfold if agreement cannot be reached — and how disputes can most effectively be resolved without the cost, delay, and stress of litigation.
Why Mediate Relationship Property, Estate and Trust Disputes?
Relationship property, estate and trust disputes are often uniquely challenging. They commonly involve high emotional stakes, long‑standing family dynamics, multiple parties with competing interests, and overlapping legal and fiduciary obligations.
Mediation provides an opportunity to resolve these disputes in a confidential, cost‑effective and timely way, while allowing parties to retain control over outcomes that affect their finances, families and future relationships.
In relationship property matters, mediation can assist parties to resolve complex financial arrangements, including trust and company structures, and to reach future‑focused outcomes without the cost and stress of protracted litigation. In estate and trust disputes, mediation also allows for practical and creative solutions that a court may not be able to order, and can help prevent legal costs from significantly eroding estate or trust assets.
